(브레이크뉴스인천 박상도 기자) 법무부가 6일, 올해 1월부터 5월까지 ‘외국인 불법 배달 라이더‘ 집중 단속을 실시하여, 불법 취업‧고용 등 ‘출입국관리법’제17조(외국인의 체류 및 활동범위), 제18조(외국인 고용의 제한)을 위반한 혐의로 외국인 총 734명과 배달 영업점 16곳을 적발했다고 밝혔다. 

법무부에 따르면, 이는 전년도 적발된 67명에 비해 약 11배 증가한 수치로, 출입국‧외국인정책본부는 국내 배달업의 성장과 함께 외국인들의 불법적 유입도 커진 것으로 분석하고 있다다.

적발된 외국인의 국적은 베트남 444명(61%), 중국 164명(22%), 우즈베키스탄 86명(12%), 기타 국가 40명(5%)이었으며, 외국인 체류자격 유형별로는 유학생(D-2) 410명(56%), 재외동포(F-4) 149명(20%), 구직자(D-10) 99명(14%), 기타 76명(10%)이었고, 적발된 유학생이 소속된 대학은 총 96곳으로 확인됐다.

출입국‧외국인정책본부는 외국인들의 법 위반 정도, 불법 취업 기간, 체류 실태 등을 감안하여 68명을 강제퇴거 하는 등 출국조치하고, 643명에게는 범칙금 총 16억 2,870만원을 부과(1인당 최대 1,000만원, 최소 100만원)했다.

나머지 20명은 조사 중이며, 2명은 고발, 1명은 지명수배자로 확인되어 경찰에 신병을 인계했다.

적발된 외국인 중 무면허로 확인된 외국인 15명은 보강조사 후 경찰에 수사 의뢰할 예정이다.

또한, 다른 사람의 배달 라이더용 앱 계정을 외국인들에게 제공한 배달 영업점주 16명도 적발하여 수사를 진행 중이다. 

출입국·외국인정책본부는 무자격 외국인의 불법 배달 라이더 취업을 근절하기 위해서는 배달 라이더용 앱을 제공하는 배달 플랫폼 업체와 배달 영업점의 자구 노력이 필요하다는 판단에 따라, 2026년 5월11일 배달 플랫폼 업체와 간담회를 개최했고 배달 라이더용 앱에 신원을 확인하는 ’안면 인증 시스템 도입’ 및 배달 영업점에 대한 관리 강화 등을 플랫폼 업체에 권고했다.

정성호 법무부장관은“불법 배달 라이더 외국인뿐만 아니라, 명의제공 브로커에 대한 수사도 강화하여 배달업 분야에서 국민고용 침해를 사전에 예방하고, 관계기관 및 플랫폼 업체와 협력하여 불법 배달을 유발하는 환경을 근본적으로 차단할 것”이라고 밝혔다.
