유동수 의원, 개인 채무자 권리·의무 균형 방안 마련 시급 지적
지난 3년간 73.5만 명 빚 탕감받아, 2회 이상 개인회생 신청자 4만9,625명에 달해

(브레이크뉴스인천 박상도 기자) 개인 채무자의 권리·의무가 균형을 이룰 방안 마련이 시급하다는 지적이 나왔다.


유동수 의원(제20대·제21대 인천계양갑, 더불어민주당 정책위원회 수석부의장)이 신용회복위원회로부터 받은 자료에 따르면 지난 3년간 신복위로 채무조정을 신청한 인원은 33만2,133명에 달했다.


이중 채무조정이 이뤄진 인원은 신청자의 약 90%인 29만7,374명, 금액으로는 7조2,039억 원에 달했다.

 
정부는 코로나로 고통받는 소상공인 자영업자의 금융부담을 고려해 만기연장·상환유예 조치를 하고 있지만 이마저도 상환하지 못하는 사람의 수는 줄지 않고 있다.


정부 조치가 끝나면 한계상황을 이미 넘어서 회생·파산이 불가피한 채무자가 늘어날 것은 불 보듯 뻔하다.


이러한 상황이 오기 전 취약차주 연착륙 방안이 시급하다는 우려 섞인 목소리가 나온다.


유동수 의원이 신용회복위원회 자료와 대법원 통계월보를 분석한 결과 최근 3년간 법원 개인파산·회생·면책과 신용회복위원회 개인워크아웃 확정을 통해 빚의 일부라도 탕감받은 채무자 수는 73.5만 명에 달했다.

 
대법원 통계월보에 따르면 올해 8말까지 개인 파산신청은 3만3,826건, 개인회생은 5만4,004건, 면책은 3만3,106건이 접수됐다.


이 중 파산은 3만2,739건, 회생은 4만5,387건, 면책은 3만1,683건이 인용됐다.

 

동기간 신용회복위원회의 개인워크아웃 역시 8만3,942건 중 7만5,414명에 대해 채무조정이 이뤄졌다.


채무자는 다급한 나머지 폐업과 파업 외에도 해결방안이 있음에도 당장 채무의 늪에 빠져 폐업, 파산만을 우선 선택한다.


특히, 채무자들 대부분은 공적·사적 채무조정제도의 장점과 단점에 대한 정보를 얻지 못하는 등 제한된 정보만으로 역선택하게 되는 것이다.

 
유동수 의원은 “채무자의 파산·회생 채무조정은 당장의 연체 채무를 조정하는 응급수술이라면 신용복지위원회의 사전 컨설팅은 채무자의 상태에 대한 진단을 통해 가장 나은 것이 무엇인지 돕는 역할이다”며 “채무자가 파산과 회생 전 정확한 진단으로 선의의 피해를 당하지 않도록 개인 채무자의 권리·의무가 균형을 이룰 방안 마련이 시급하다”고 지적했다.

 
한국과 달리 상당수 선진국은 채무 면책에 깐깐한 조건을 달고 있다.


독일·네덜란드는 채무자가 사전에 신용상담을 거치고 빚을 갚기 위해 최선을 다했다는 사실을 법원에 증명해야만 개인파산 신청을 할 수 있다.


프랑스는 절차가 더 복잡하다.


개인 채무자는 곧바로 법원으로 갈 수 없고 반드시 정부기구인 ‘과채무위원회’의 상담과 심사를 거쳐야 한다.


법원으로 보낼지, 말지는 과채무위원회가 결정한다.

 
미국도 2005년 연방도산법을 개정해 법원에 개인파산 신청을 하기 전에 사전 신용상담을 의무화했다.


또, 파산 선고를 내린 뒤 최종 효력이 발생하기 전에 채무자가 반드시 신용교육을 받도록 한다.


쉬운 면책으로 인해 도덕적 해이가 발생하는 것을 막는 동시에 면책 뒤 다시 빚 수렁에 빠지는 일이 없도록 하기 위해서다.

 
하지만 우리는 파산과 면책이 선진국에 비해 관대하다.


실제 유 의원이 대법원으로부터 제출받은 자료에 따르면 최근 5년 간 개인회생을 2회 이상 신청한 사람은 4만2,071명에 달했다.


신청 횟수 2회 이상 4만2,071명, 3회 6,156회, 4회 1,106명, 5회 이상인 사람도 292명에 달했다.

 
유동수 의원은 “우리나라는 현재의 빚 부담에서 구제해주는 데 집중할 뿐, 미래의 빚 재발을 막는 방법에 대한 고민이 부족하다”며 “채무자가 파산과 회생 전에 사전컨설팅 제도를 제도화 한다면 쉬운 면책으로 인해 채무자의 도덕적 해이가 발생하는 것을 막는 동시에 면책 뒤에 다시 빚 수렁에 빠지는 일이 없도록 예방하는 효과가 있을 것이다”고 강조했다.
